    If you are currently dealing with a dispute against an insurance company and can’t seem to reach a resolution, consider filing a complaint against the insurance company.

    In this article, we go over 4 ways on how to file a complaint against an insurance company: 

    1. Send a demand letter to the insurance company.

    2. File a BBB complaint against the insurance company. 

    3. Sue the Insurance Company in small claims. 

    4. File a complaint with your state insurance regulator. 

    Types of insurance company complaints we see most often are: 

    Common Complaints Against Insurance Companies 

    Here are some common types of complaints we see against insurance companies: 

    • Failure to pay a covered claim: You file a claim that falls within your insurance policy but your insurance company denies the claim. For example, your home warranty company plan states it covers water leaks, but the home warranty company refuses to honor the coverage. 

    • Failure to reimburse you for all expenses: For example, after a car accident, you take your car to a mechanic and spend $4,000 dollars to fix your car, but your insurance only wants to pay you $2,000. You can sue your insurance company in small claims, and the judge will determine if they should have paid you the full $4,000. 

    • No response from your insurance company: Your insurance company has ignored your multiple attempts at reaching out to them to request a reimbursement. You can sue your insurance company in small claims. They are likely to respond before the hearing date, and if they don’t, a judge will determine whether you should win your lawsuit and have a valid judgment against the insurance company. 

    Option 1- Send a Demand Letter to the Insurance Company

    A demand letter is a letter outlining a set of requests you would like your insurance company to perform. For example, if the insurance company ignores your requests for reimbursement for a claim falling within the purchased insurance policy, you can make this request in the demand letter. A demand letter also serves as a notice to the insurance company that if they don’t meet your demands, you intend to sue them in small claims court

    Here are some other reasons to send a demand letter: 

    • Depending on the state you are filing a lawsuit in, you may be required to demand payment from the insurance company before filing. For example, in California small claims court, you are required to ask for payment before suing the insurance company. A demand letter is an effective way of completing this requirement. 

    • A demand letter may lead to a settlement without further legal action (and legal costs).

    Option 2- File a BBB Complaint Against the Insurance Company 

    The Better Business Bureau (“BBB”) acts as a consumer advocate by accepting and forwarding complaints against businesses like insurance companies.     Option 3- Sue the Insurance Company in Small Claims Court

    Option 4- File a Complaint Against the Insurance Company With Your State Regulator 

    If you have a problem with an insurance company, you may want to file a complaint with the government agency in your state that regulates insurance companies. The Federal Insurance Office oversees insurance companies at a federal level, but at a state level, each state regulates insurance companies differently. 

    How states regulate insurance companies: 

    • All states have specific government agencies to regulate insurance companies. 

    • These government agencies accept consumer complaints against insurance companies.

    The Alabama Department of Insurance serves the people of Alabama by regulating the insurance industry and accepting complaints against insurance companies.

    The Colorado Department of Regulatory Agencies Division of Insurance regulates the insurance industry in Colorado. The Division of Insurance Consumer Services sections is specifically in charge of investigating individual consumer complaints against insurers.

    Florida

    The Florida Office of Insurance Regulation’s mission is to promote a stable and competitive insurance market for consumers. Consumers can file insurance-related complaints with the Department through Florida’s Chief Financial Officer. Learn more here

    Georgia

    The Georgia Office of Commissioner of Insurance and Safety Fire regulates the insurance industry in Georgia. If you are dealing with an insurance-related issue, the Office of the Commissioner of Insurance may be able to assist you.

    The Hawaii Department of Commerce and Consumer Affairs Division of Insurance oversees the insurance industry in the state of Hawaii. On the Department of Commerce and Consumer Affairs website, you will find educational tools and resources, an insurance license search database, and be able to file an insurance complaint.

    Idaho

    The Idaho Department of Insurance is a regulatory agency created to regulate insurance entities in Idaho. Part of the Insurance Division's job is to look into complaints filed by consumers.

    Additional information to consider when filing a complaint: 

    • If this complaint pertains to health insurance provided by your employer, you are encouraged to complete the internal appeal process as described in your insurance policy before filing a complaint with the Department of Insurance. 

    • If your complaint pertains to a warranty, you will need to contact the Idaho Attorney General’s office. Learn more here

    Illinois

    The Illinois Department of Insurance’s mission is to protect consumers by providing assistance and information about the insurance industry. The Illinois Department of Insurance offers helpful resources like a company lookup database and assists consumers with complaints against insurance companies.

    The Indiana Department of Insurance’s mission is to protect and inform consumers in Indiana while ensuring a strong insurance market. The Consumer Services Division is tasked with reviewing complaints and compiling reports so the public can evaluate various insurance companies and agents and make informed market decisions.

    The Kansas Insurance Department is responsible for regulating, educating, and advocating for consumers in Kansas. The Kansas Insurance Department also handles consumer complaints against insurance companies.
